These Website Terms of Use (“Website Terms”) apply to your access to and use of the TapHero website located at https://taphero.com and any related public webpages (the “Site”).

By using the Site, you agree to these Website Terms and your use of the Site is subject to our Privacy Policy.

1. Use of the Site

You may use the Site for lawful purposes only.

You agree not to:

  • misuse the Site
  • interfere with its operation
  • attempt to gain unauthorized access to systems or data
  • use the Site in a way that could harm TapHero or others

2. Informational Purpose Only

The Site is provided for general informational and marketing purposes.

Content on the Site does not constitute professional advice and should not be relied on as such.

3. No Service Relationship

Use of the Site does not create a customer relationship with TapHero.

If you use TapHero’s software platform, your use is governed by a separate written agreement between TapHero and your building, homeowners association, or property manager.

4. Intellectual Property

The Site and its content (including text, graphics, logos, and software) are owned by TapHero or its licensors.

You may not copy, reproduce, modify, or distribute any part of the Site without prior written permission, except for personal, non-commercial use.

5. Submissions

If you submit information through the Site (for example, through a contact form), you grant TapHero the right to use that information to respond to your request and operate its business.

You should not submit sensitive information through the Site.

6. Third-Party Links

The Site may contain links to third-party websites or services.

TapHero is not responsible for those third parties or their content.

7. No Warranties

The Site is provided “as is” and “as available.”

TapHero does not guarantee that the Site will be:

  • error-free
  • secure

10. Governing Law; Venue

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be governed by the laws of the State of Delaware, without regard to its conflict of laws rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida for any such dispute, claim, or controversy, and you waive any objection to such courts based on venue, inconvenience, or lack of personal jurisdiction.

Privacy Policy

TapHero, Inc. (“TapHero,” “we,” “our,” or “us”) provides software tools that help residential buildings manage operations, communications, and package workflows.

This Privacy Policy explains how we collect, use, and protect personal information when people interact with the TapHero website, platform, and related services (the “Services”).

1. Scope

This Privacy Policy applies to:

  • visitors to our website
  • individuals who interact with our platform (including residents, staff, and service providers)
  • individuals who receive communications generated through the platform

TapHero provides its Services to building owners, homeowners associations, and property managers (“Customers”). These Customers control how the Services are used in their buildings.

2. Information We Collect

We may collect personal information such as:

  • name
  • address or unit number
  • email address or phone number
  • vehicle or license plate information
  • visitor details
  • service request information
  • package delivery details
  • images of packages or shipping labels
  • communication history

We may also collect technical information such as device type, browser type, IP address, and usage activity.

TapHero does not store full payment card numbers. Payments are processed by third-party providers such as Stripe.

The Services are not directed to children, and TapHero does not knowingly collect personal information directly from children without appropriate authorization.

3. How We Use Information

We use personal information to:

  • provide and operate the Services
  • manage communications and service requests
  • log package deliveries and building events
  • send notifications or reminders
  • provide customer support
  • improve functionality and performance
  • maintain security and prevent misuse

Some features may use automated systems or artificial intelligence to help classify information, route requests, or generate communications. Some automated or AI-assisted features may be provided using third-party service providers. We do not permit such providers to use personal information submitted through the Services to train their general-purpose AI models, except where expressly disclosed or authorized.

4. Processing on Behalf of Customers

TapHero processes personal information on behalf of its Customers.

Customers determine how the Services are used and are responsible for their own privacy practices, including providing notices and obtaining any necessary permissions from residents, staff, and other individuals.

If a Customer uses the Services to send building announcements, notices, package alerts, maintenance updates, or other communications, we process recipient information and communication content on behalf of that Customer.

5. Package and Image Processing

Building staff may upload images of packages or shipping labels.

TapHero processes these images to help identify shipment details and support building workflows.

These processes may not always be accurate. Buildings remain responsible for verifying delivery decisions.

6. How Information Is Shared

We may share information:

  • with the Customer (building or property manager) using the Services
  • with service providers that help us operate the Services (such as cloud hosting, messaging services, analytics providers, and payment processors)
  • when required by law or to protect safety and rights

We do not sell personal information, and we do not use personal information collected through the Services for cross-context behavioral advertising.

7. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, support building operations, comply with legal obligations, and resolve disputes.

Retention periods may vary depending on Customer configuration and operational needs. For example, package logs, communications, service requests, and resident records may be retained for different periods depending on Customer settings, legal needs, backup cycles, and operational requirements.

8. Data Security

We use commercially reasonable technical and organizational measures designed to protect personal information.

However, no system can guarantee complete security.

9. Your Rights and Choices

Depending on applicable law, individuals may have rights to access, correct, or request deletion of their personal information.

Because TapHero provides Services on behalf of Customers, requests may need to be directed to the relevant building or property manager.

10. Third-Party Services

The Services may include links to or integrations with third-party services. TapHero is not responsible for those third parties.

Use of Google User Data

TapHero’s use of information obtained from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

Google user data accessed via Google APIs is used solely to provide and improve the core functionality of the TapHero services as explicitly requested by the user, such as authentication, scheduling, and calendar-related features.

TapHero does not use Google user data for advertising, marketing, profiling, resale, or any purposes unrelated to the functionality of the Services.

TapHero does not allow human access to Google user data except as necessary for security, support, or compliance with applicable law.

11. Changes to This Policy

We may update this Privacy Policy from time to time.

If changes are material, we will provide reasonable notice where appropriate.

Platform Terms of Use

TAPHERO PLATFORM TERMS OF USE

These TapHero Platform Terms of Use (the “Platform Terms”) are between TapHero, Inc. (“TapHero”) and the entity that accepts these Platform Terms or is identified as the customer in an applicable order form, ordering document, statement of work, or similar document that incorporates these Platform Terms (each, an “Order Form”) (“Customer”).

By signing an Order Form, clicking to accept these Platform Terms, accessing or using the Platform, or allowing Customer Personnel to access or use the Platform, Customer agrees to these Platform Terms.

Each Order Form incorporates these Platform Terms and TapHero’s Privacy Policy by reference, unless the Order Form expressly states otherwise.

References to an “Agreement” mean the applicable Order Form together with these Platform Terms and any other documents expressly incorporated by reference.

1. What TapHero Provides

TapHero provides a hosted software platform that helps buildings manage resident communications, service requests, operational workflows, package logging, notifications, analytics, and related features (the “Platform”).

TapHero provides software tools only. TapHero does not perform property management, concierge services, security services, mailroom services, vendor services, or other building operations.

2. Who May Use the Platform

Customer may allow its employees, property managers, contractors, concierge staff, mailroom staff, security personnel, and other service providers acting on Customer’s behalf (“Customer Personnel”) to use the Platform.

Customer is responsible for all use of the Platform by Customer Personnel.

Residents and other third parties may interact with certain Platform features, but they are not parties to these Platform Terms unless they separately accept them.

3. Customer Responsibilities

Customer is responsible for:

  • operating and supervising building staff and vendors
  • managing mailroom and package delivery procedures
  • verifying resident identity and delivery decisions
  • ensuring internet access, devices, and local systems needed to use the Platform
  • ensuring that Customer Personnel are trained in proper use of the Platform
  • ensuring that Customer’s agreements with residents, property managers, and vendors permit use of the Platform
  • provisioning, configuring, monitoring, and disabling access for Customer Personnel and for ensuring that role permissions, resident records, unit assignments, vendor records, and notification settings are accurate and appropriate.
  • all decisions and actions taken using information provided by the Platform.
  • all activity occurring through Customer’s account. TapHero may suspend, limit, throttle, or disable access to the Platform, or block particular communications, content, accounts, or users, if TapHero reasonably believes that use of the Platform violates these Platform Terms or may harm TapHero, the Platform, its service providers, or third parties.

Customer will not, and will not permit Customer Personnel or other users acting through Customer’s account to:

  1. use the Platform for any unlawful, fraudulent, deceptive, harassing, abusive, discriminatory, or harmful purpose;
  2. use the Platform to send spam, phishing messages, unsolicited marketing communications, or other communications that violate applicable law or recipient preferences;
  3. upload, transmit, or store content or personal information in violation of applicable law, privacy obligations, building rules, leases, resident agreements, or third-party rights;
  4. use the Platform as an emergency response system, life-safety system, security monitoring system, fire alarm system, medical alert system, law enforcement dispatch system, or other time-critical service;
  5. interfere with, disrupt, overload, probe, scan, or attempt to gain unauthorized access to the Platform, related systems, other customer accounts, data, or credentials;
  6. copy, scrape, reverse engineer, resell, sublicense, or use the Platform to build or benchmark a competing product, except to the extent permitted by applicable law; or
  7. use the Platform in a way that could create legal, security, operational, reputational, or deliverability risk for TapHero, the Platform, its service providers, or third parties.

4. Package Management Features

The Platform may allow Customer Personnel to upload images of packages or labels, record receipt of packages, and log delivery events.

TapHero processes this information to help identify shipment details and provide workflow tools.

Customer retains sole custody, control, and responsibility for all physical packages and deliveries. TapHero does not receive, store, transport, insure, or deliver packages. Customer is solely responsible for establishing and enforcing package intake, storage, release, identity verification, signature, photograph, and pickup procedures.

Information generated by the Platform regarding packages may be incomplete or inaccurate. Customer Personnel must verify package details and delivery actions. Any package status, recipient match, label extraction, routing suggestion, notification, or delivery record generated through the Platform is a software record only and does not independently verify physical custody, condition, delivery, pickup, identity, or entitlement to receive a package.

Nothing in these Platform Terms creates a bailment or custodial relationship between TapHero and Customer or any resident.

5. Automated and AI-Assisted Features

Some Platform features may use automated systems or artificial intelligence to classify information, route requests, generate summaries, or send notifications.

These outputs are advisory and may contain errors. Customer remains responsible for reviewing and determining appropriate actions.

TapHero is not responsible for consequences resulting from Customer’s reliance on automated outputs.

6. Resident Communications

The Platform may allow Customer to send emails, text messages, notices, alerts, announcements, reminders, or other communications to residents, owners, tenants, vendors, staff, or other recipients. Customer is solely responsible for: (a) the content of all such communications; (b) the selection, accuracy, and lawful use of recipient lists and contact information; (c) obtaining and maintaining all consents, opt-ins, authorizations, and permissions required to send such communications, including any consents required for text/SMS messaging; (d) honoring opt-out requests, STOP requests, unsubscribe requests, and communication preferences where required; and (e) ensuring that all communications comply with applicable laws, carrier and messaging provider requirements, building rules, governing documents, leases, resident agreements, and privacy requirements.

Customer will not use the Platform to send unsolicited, unlawful, deceptive, or abusive communications, or communications to any recipient who has opted out or has not provided any legally required consent. Customer is responsible for maintaining records sufficient to demonstrate required consent or authorization upon request. TapHero does not guarantee delivery, receipt, open rates, deliverability, or that communications will be timely, accurate, or legally sufficient for any particular purpose. TapHero may limit, throttle, suspend, or block communications if TapHero reasonably believes Customer’s use may violate law, carrier or messaging provider requirements, harm deliverability, generate excessive complaints, or create risk to TapHero, the Platform, or third parties.

7. Fees

Customer will pay the fees described in the applicable Order Form. Trial periods, subscription terms, renewal terms, payment timing, billing frequency, and special pricing terms may be specified in the applicable Order Form.

TapHero may change fees for future subscription periods with advance notice, unless the applicable Order Form states otherwise.

Fees are non-refundable unless otherwise stated in the applicable Order Form or required by law. Customer is responsible for applicable taxes, excluding taxes based on TapHero’s net income.

8. Customer Data and Privacy

Customer owns all data submitted to or generated through its use of the Platform (“Customer Data”), including information relating to residents, visitors, vehicles, packages, and communications.

Customer grants TapHero permission to host, store, process, transmit, and analyze Customer Data as reasonably necessary to provide and improve the Platform.

Customer is responsible for:

  • providing notices
  • obtaining permissions
  • complying with privacy and data protection laws

TapHero may use aggregated or de-identified data to improve services.

TapHero will implement commercially reasonable safeguards designed to protect Customer Data.

TapHero will not use Customer Data to train general-purpose artificial intelligence models except as expressly permitted in an Order Form or other written agreement. TapHero may use Customer Data to provide, maintain, secure, support, troubleshoot, and improve the Platform, including through aggregated, de-identified, or anonymized data that does not identify Customer, residents, or other individuals.

TapHero processes personal information in accordance with its Privacy Policy. The Privacy Policy describes TapHero’s privacy practices and is incorporated for purposes of those disclosures; it does not override these Platform Terms or any Order Form unless expressly stated.

9. Third-Party Services

The Platform may integrate with third-party services such as messaging providers, cloud storage, shipping data sources, or payment processors.

Payment information may be processed by third-party providers such as Stripe. TapHero does not store full payment card details.

TapHero is not responsible for third-party services.

10. Platform Availability

TapHero will use commercially reasonable efforts to keep the Platform available.

The Platform may occasionally be unavailable due to maintenance, upgrades, outages, or factors outside TapHero’s control.

11. Warranty Disclaimer

The Platform is provided “as is.”

TapHero does not guarantee that the Platform will be error-free, uninterrupted, or suitable for Customer’s specific operational needs.

TapHero does not guarantee accuracy of package information, automated communications, workflow routing, analytics, or other outputs.

12. Limitation of Liability

To the maximum extent permitted by law:

TapHero will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, business interruption, or claims relating to lost or misdelivered packages.

TapHero’s total liability arising from or relating to the Agreement will not exceed the fees paid by Customer to TapHero under the applicable Order Form in the twelve months before the claim.

13. Indemnification

Customer will defend and indemnify TapHero from claims arising out of:

  • Customer’s building operations
  • actions of Customer Personnel
  • package handling or delivery disputes
  • Customer’s failure to obtain required permissions
  • misuse of the Platform

14. Term and Termination

The Agreement continues for the subscription term stated in the applicable Order Form. Any trial period, automatic conversion after trial, renewal term, month-to-month term, or convenience termination right will be as stated in the applicable Order Form.

Either party may terminate the Agreement for material breach if the breach is not cured within 30 days after written notice.

TapHero may suspend access if Customer’s use creates security risk, legal exposure, or harm to the Platform.

Upon termination or expiration of the Agreement, TapHero may disable access to the Platform. Upon Customer’s reasonable written request made within 30 days after termination or expiration, TapHero will make commercially reasonable efforts to provide an export of Customer Data reasonably available for export in a commonly used format. After that period, TapHero may delete Customer Data in accordance with its standard retention practices, except where retention is required for legal, security, backup, fraud-prevention, or dispute-resolution purposes.

15. General Terms

These Platform Terms, each Agreement, and any dispute, claim, or controversy arising out of or relating to these Platform Terms, the Agreement, the Platform, or any Order Form will be governed by the laws of the State of Delaware, without regard to its conflict of laws rules. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida for any such dispute, claim, or controversy, and each party waives any objection to such courts based on venue, inconvenience, or lack of personal jurisdiction.

Neither party is responsible for events beyond reasonable control.

Each Agreement consists of the applicable Order Form, these Platform Terms, and any documents expressly incorporated by reference, and represents the entire agreement between the parties regarding the subject matter of that Order Form.

If there is a direct conflict between an Order Form and these Platform Terms, the Order Form controls only with respect to the specific business terms stated in that Order Form, including customer or property details, trial period, fees, payment terms, subscription term, termination rights, export commitments, or other expressly identified special terms. These Platform Terms control all other terms. The Privacy Policy describes TapHero’s privacy practices and controls with respect to TapHero’s public privacy disclosures.
